SUMMARY

OF MAY 3, 2013, CONFERENCE CALL WITH NORTHERN STATES POWER COMPANY MINNESOTA (NSPM) TO DISCUSS APPLICATION OF 10 CFR 26.205(d)(6) DURING THE CURRENT REFUELING OUTAGE (TAC NO. MD7121)

On May 3, 2013, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a conference call with staff from Northern States Power Company - Minnesota (NSPM, the licensee) to discuss application of Title 10 ofthe Code of Federal Regulations (10 CFR) 26.205(d)(6) as it applies to supplemental workers who had not previously performed covered work during the current refueling outage (RFO) at the Monticello Nuclear Generating Plant (MNGP). A list of participants in the teleconference is provided as an enclosure.

DISCUSSION The licensee requested a teleconference with the NRC staff to discuss the conditions under which application of 10 CFR 26.205(d)(6) allows licensees to extend the 60-day outage exception for work hours. During the discussion, the licensee indicated that workers are currently tracked in the NSPM program for controlling the work hours of plant personnel and contractors subject to the requirements of 10 CFR Part 26, "Fitness for Duty Programs."

Specifically, the licensee was requesting clarification of the regulations in 10 CFR 26.205(d),

"Work control hours," as it may be applied to supplemental workers that had not performed covered work at MNGP during the current RFO.

On May 3,2012, MNGP was in Day 63 of its current RFO. The licensee indicated that NSPM was intending to apply the extension per 10 CFR 26.205(d)(6) to supplemental workers that had not performed covered work at MNGP previously during the outage (e.g., the individual may have performed work at a non-nuclear construction site). The licensee inquired as to whether worker hours could be extended in 7 -day increments for each 7 -day prior period that an individual had worked not more than 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />.

The licensee cited an example provided in Section 8.3 of the Nuclear Energy Institute (NEI) 06-11, Revision 1, "Managing Personnel Fatigue at Nuclear Power Reactor Sites," issued in October 2008. NEI 06-11 provides information and describes the methods applicable to implement the requirements of Subpart I of 10 CFR Part 26. The document describes the processes and procedures that licensees may use to manage personnel fatigue with an emphasis on procedures for implementing work-hour and rest-hour requirements of 10 CFR 26.205. The licensee indicated during the teleconference that per the guidance in NEI 06-11 for individuals that had not worked for a licensee, that covered workers could be extended in increments of 7 -days in accordance with 10 CFR 26.205(d)(6) for workers that had not previously worked during the current MNGP RFO.

- 2 The NRC staff informed the licensee that although it was acceptable to reference NEI 06-11, it also needed to further review and reference the guidance in Regulatory Guide (RG) 5.73, "Fatigue Management for Nuclear Power Plant Personnel," issued in March 2009. In RG 5.73, the NRC staff endorses Revision 1 of NEI 06-11, with certain clarifications, additions, and exceptions.

At the conclusion of the teleconference, the NRC staff indicated that it was acceptable for the licensee to extend the 60-day exception for individuals by one week for each 7-day period, if an individual had not worked more than 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> during the outage, including supplemental workers that had not performed covered work at MNGP previously during the outage. The extension must be based on an individual's actual work history, and that documentation shall be available for subsequent NRC inspection, if required.

No commitments or regulatory decisions were made by the NRC staff during the teleconference.
