Duke Energy to NRC Letter, Crystal River Unit 3 - Certificationof Permanent Cessation of Power Operationsand that Fuel Has Been Permanently Removed from the Reactor, dated February 20, 2013 On March 12, 2012, the Nuclear Regulatory Commission (NRC) issued Reference 1 to all power reactor licensees and holders of construction permits in active or deferred status. Enclosure 1 of Reference 1 contains specific Requested Actions, Requested Information, and Required Responses associated with Recommendation 2.1, Seismic Evaluations. Reference 1 requires a "60-day response" in which each addressee must submit: (1) its intent to follow the developed guidance, or (2) an alternative approach including acceptance criteria. In accordance with References 1 and 2, the 60-day responses are due to the NRC by April 29, 2013.

Carolina Power and Light Company (CP&L) and Florida Power Corporation (FPC) intend to respond to Enclosure 1 of Reference 1 by following the approach described in Reference 3, and on the schedule provided in Reference 3 for the above plants. However, due to the recent decision to retire Crystal River Unit 3 Nuclear Generating Plant (CR-3) and certification of permanent cessation of power operations (Reference 4), FPC is in the process of assessing the scope of future responses to Reference 1, including the need to perform additional seismic

United States Nuclear Regulatory Commission RA-1 3-009 Page 2 evaluations. FPC plans to initiate interactions with the NRC staff to better define the applicability of Reference 1 based on the decision to retire CR-3. Therefore, based on the outcome of these interactions, the intentions stated above to follow the approach described in Reference 3 could change for CR-3.

This letter contains no new regulatory commitments.
