Changes to RFOLC 3.P and 3.Q
- Phil, As discussed, the NRC staff has revised the proposed wording for RFOLC 3.P and 3.Q as shown below. Specifically, proposed RFOLC 3.P is revised from the licensee's proposed wording (submitted in letter dated November 20, 2012) to simplify/consolidate the numeric listing of commitment nos. and to replace "is henceforth" with "shall be incorporated as" to be more consistent with standard license condition language/format. For proposed RFOLC 3.Q, the NRC staff considers it appropriate to delete 3.Q, as Pilgrim has already entered the period of extended operation, and therefore, the original license condition 3.Q is no longer applicable.
Additionally, the format of 3.Q would be consistent w/other previously deleted LCs in VY's Operating License. The reason for the changes are considered administrative in nature in that they provide additional clarity to the license conditions.
Please review the proposed 3.P and 3.Q shown below for accuracy and completeness, and confirm that the licensee agrees that the proposed wording can supersede the previous intended proposed RFOLC 3.P and 3.Q. Any comments or questions, please let me know.
P. The information in the UFSAR supplement, submitted pursuant to 10 CFR 54.21(d), as revised during the license renewal application process, as supplemented by Commitment Nos. 1-5, 6 (as revised by Entergy Nuclear Vermont Yankee, LLC letter dated May 19, 2011), 7-36, 38, 39, 42, 43, and 45-55 of Appendix A of Supplement 2 of NUREG-1907 shall be incorporated as part of the UFSAR which will be updated in accordance with 10 CFR 50.71(e). As such, Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. may make changes to the programs and activities described in the UFSAR supplement and Commitment Nos. 1-5, 6 (as revised by Entergy Nuclear Vermont Yankee, LLC letter dated May 19, 2011), 7-36, 38, 39, 42, 43, and 45-55 of Appendix A of Supplement 2 of NUREG-1907 provided Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. evaluates such
changes pursuant to the criteria set forth in 10 CFR 50.59 and otherwise complies with the requirements in that section.
