REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR MILLSTONE POWER STATION, UNIT NO.2 (TAC NO. MF0435)
Dear Mr. Heacock:
By letter dated December 17, 2012, Dominion Nuclear Connecticut, Inc. (DNC) submitted the affidavit executed by Mr. J. Alan Price, Vice President - Nuclear Engineering, on behalf of Dominion Resources Services, Inc. (DRS), dated December 17,2012.
The affidavit requested that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR)
Section 2.390: to the letter from Dominion Nuclear Connecticut, Inc., (Mr. J. Alan Price, Vice President-Nuclear Engineering), Serial No: 12-678, dated December 17,2012, "Criticality Safety Analysis Report (Proprietary)."
The affidavit from Mr. J. Alan Price on behalf of DRS stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

The information is of a type that is held in confidence by DRS and DNC, and there is a rational basis for doing so because the information contains sensitive commercial information to DRS regarding methods used to analyze burnup credits as it relates to spent fuel pool criticality analyses.

Public disclosure of this information would create substantial harm to DRS by disclosing the unique, first time aspects of these methodologies to other parties not involved in the development of the criticality analyses. The methodologies were developed by DRS to analyze burnup credits for updated spent fuel pool criticality analyses in order to meet recent NRC Interim Staff Guidance (NRC Document DSSISG-201 0-01, Revision 0, "Staff Guidance Regarding the Nuclear Criticality Safety Analysis for Spent Nuclear Fuel Pools," 9/29/2011) and NUREG/CR-7108 and NUREG/CR-71 09. DRS has expended significant engineering resources in the development of this information. Therefore, disclosure of this information to other parties would permit them to use the information without the expenditure of similar resources, thus giving them a competitive advantage.

- 2 We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the versions of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b )(5) and Section 1 03(b) of the Atomic Energy Act of 1954, as amended.
A nonproprietary copy of this document has been placed in the NRC's PubliC Document Room and added to the Agencywide Documents Access and Management System Public Electronic Reading Room.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
