Dear Chairwoman Macfarlane:

I write to express my concern about the proposed restart of one of the damaged San Onofre nuclear reactors. Safety at this nuclear plant is of highest priority to me, as my constituents would be at risk in the event of an accident at San Onofre.

I appreciate all that the Nuclear Regulatory Commission (NRC) has done thus far to investigate what led to the equipment damage at San Onofre and to review the safety of Southern California Edison's restart plan. However, members of the public remain concerned about the replacement steam generators, which failed shortly after being installed, risking public health and safety. This concern has been underscored by Senator Boxer and Congressman Markey's recent letter to the NRC indicating Mitsubishi Heavy Industries (MHI) reported MHI and Edison did not address potential safety problems in the replacement steam generators in order to avoid a license amendment.

I hope that as the Commission considers the proposed restart of the plant that the Commission takes every step to ensure that safety will not be compromised and that a rigorous review of the plan will be conducted. Tomorrow's oral argument on a request for a hearing on the Confirmatory Action Letter in front of the Atomic Safety and Licensing Board is an important step, but there must be more outreach so that the public is aware. In addition, I am encouraged by NRC staff's issuance of additional Requests for Additional Information (RAI) to Southern California Edison Company, and urge you to issue additional RAls as your review continues. Because public trust has been shaken, discussion of the RAIs in a public meeting near the San Onofre reactors would be a step to rebuild that trust. Going forward, it is imperative that, with so much at stake, the NRC exercise the greatest abundance of transparency and caution.
