Docket Nos. 50-352-LR/ 50-353-LR RE: Change to the Schedule for the Site-Specific Environmental Impact Statement

Dear Administrative Judges:

This letter informs the Board that the NRC Staff has updated the schedule for its environmental review regarding the license renewal application for the Limerick Generating Station. The attached letter from John W. Lubinski, Director, Division of License Renewal, Office of Nuclear Reactor Regulation, to Michael P. Gallagher, Vice President License Renewal Projects, Exelon Generation Company, LLC, provides the updated schedule. The updated schedule indicates that the NRC Staff intends to publish the Draft Supplemental Environmental Impact Statement for the Limerick Generating Station in April of 2013. The Staff plans to publish a final version of that document in November of 2013.

Sincerely, Signed (electronically) by Maxwell C. Smith Counsel for NRC Staff U.S. Nuclear Regulatory Commission Office of the General Counsel Mail Stop - O-15D21 Washington, DC 20555 Telephone: (301) 415-1246 E-mail: maxwell.smith@nrc.gov Date of signature: March 8, 2013

REVISION OF SCHEDULE FOR THE CONDUCT OF ENVIRONMENTAL REVIEW OF THE LIMERICK GENERATING STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION

Dear Mr. Gallagher:

By letter dated June 22, 2011, Exelon Generation Company, LLC (Exelon) submitted an application pursuant to Title 10 of the Code of Federal Regulations Part 54 (10 CFR Part 54), to renew operating licenses NPF-39 and NPF-85 for Limerick Generating Station, Units 1 and 2 (LGS), for review by the U.S. Nuclear Regulatory Commission (NRC or the staff). This letter is to inform you about a schedule change in the LGS license renewal review.

On August 20,2012, NRC sent a letter with a revised schedule for the LGS environmental schedule. The schedule was revised because of the United States Court of Appeals for the District of Columbia Circuit decision on the NRC waste confidence rule update (10 CFR Part 51.23). Because the Draft Supplemental Environmental Impact Statement (DSEIS) for LGS discusses issues related to waste confidence, the staff needed additional time to ensure that the DSEIS is consistent with the Commission's directions on waste confidence. That schedule indicated that future environmental milestones were to be determined after the staff completed this process. The NRC is now able to determine the schedule for completing the LGS environmental review.

Enclosed is a revised schedule for the review of the LGS license renewal application. The schedule has been updated to reflect a change in the date for the issuance of the DSEIS and the subsequent environmental review milestones.

If you have any questions on the revised schedule, please contact Leslie Perkins by telephone at 301-415-2375 or bye-mail atleslie.perkins@nrc.gov.//

Sincerely, //
