RE: JLD presentation on 5/8/12- Oconee slides (OiIcW

John, We performed an inspection of the licensee's interim compensatory measures for external flood (as specified in the CAL) to verify that they were in place and the strategy could work. It was documented in IR 2010006 issued July 7, 2010, ML101880768 (OUO-SRI) and ML101880769 (Public)

Jonathan, please state which inspection/verification of the ICMs you are referring to. For example, what is the ML number or date of the inspection report?

RE: JLD presentation on 5/8/12- Oconee slides (O1 Can we also insert - into the "history" slides, an entry on our inspection/verification of the ICMs? Also, not sure we should use the word "reluctant" on slide 4....

RE: ILD presentation on 5/8/12- Oconee slidespn) 1

I suggest the recommendation slide indicate that we would affirm "by letter" to Duke that the current NRC safety evaluation provides, adequate protection of public health... Also, there should something about the acceptable standards to be followed. Perhaps:

Affirm "by letter" to Duke that the current NRC safety evaluation provides adequate protection of public health and safety, and proceed with design and construction of the flood walls "following FERC and Army Corps of Engineer standards."

JLD presentation on 5/8/12-Attached is the draft of the Oconee slides. Please let me know if you have any comments. The reason I used the phrase "adequate protection of public health and safety," is because it will then require the use of the backfit rule to add additional requirements on Duke, which I believe is the level of assurance they desire before proceeding with construction of flood walls.
