Gentlemen:

The Reference provided Wolf Creek Nuclear Operating Corporation's (WCNOC) License Amendment Request (LAR) that proposed changes to the approved fire protection program as described in the Wolf Creek Generating Station (WCGS) Updated Safety Analysis Report (USAR). WCNOC proposed changes to the approved fire protection program based on the Reactor Coolant System (RCS) thermal-hydraulic response (Evaluation SA-08-006) for a postulated control room fire performed for changes to the alternative shutdown methodology outlined in letter SLNRC 84-0109, "Fire Protection Review."

In a teleconference with Nuclear Regulatory Commission (NRC) personnel on January 29, 2013, the NRC informed WCNOC that the acceptance review identified that information insufficiencies in the Reference resulted in a determination that the requested licensing action is unacceptable without opportunity to supplement. During the teleconference, the NRC provided verbally the reasons for the NRC staff actions. Therefore, in accordance with 10 CFR 2.107, "Withdrawal of application," WCNOC is withdrawing the license amendment request submitted by the Reference. WCNOC requests the NRC document the information insufficiencies in its withdrawal acknowledgement letter.
