SUMMARY

OF A TELECONFERENCE ON NOVEMBER 27,2012, BETWEEN NUCLEAR REGULATORY COMMISSION STAFF AND DUKE ENERGY CAROLINAS, LLC REGARDING APPLICATION TO EXTEND DUE DATES IN THE NFPA 805 LICENSE CONDITION By application dated July 31, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12262A372), as supplemented by letter dated September 5,2012 (ADAMS Accession No. ML12251A010), Duke Energy Carolinas, LLC (Duke or the licensee),

submitted a license amendment request (LAR) which requested changes to the license conditions for the Oconee Nuclear Station, Units 1, 2, and 3 (Oconee), for completing transition to a revised fire protection program using the National Fire Protection Association (NFPA)

Standard 805.

The proposed changes requested to extend the due dates for certain plant modifications required by a previous license amendment which approved the transition to NFPA 805 for Oconee. That previous license amendment was issued on December 29,2010, ADAMS Accession No. ML103630612. The current license condition requires Duke to complete certain plant modifications and documentation at Oconee by January 1, 2013. The requested change would extend the completion date to December 31,2014, a two year extension. In a previous call with Duke, the NRC staff indicated that milestones would need to be agreed on which showed partial progress and risk reduction during the two year period. A call with Duke was held on November 27, 2012, to discuss Duke's proposed milestones. Most of the milestones were associated with the new Protected Service Water (PSW) system installation, which contributes major risk reduction in the fire Probabilistic Risk Assessment (PRA) used to evaluate the acceptability of the transition to NFPA-805.

At this call, Duke proposed new milestones which were as follows:

1.

The power to the PSW building from the Fant line would be delayed to July 31, 2013. It had been listed as December 31, 2012, in the LAR.

2.

The power to the Standby Shutdown Facility (SSF) from the PSW building would be delayed to December 31, 2013. It had been listed as December 31, 2012, in the LAR.

3.

The power to the PSW building from the Keowee Hydro Units (KHUs) would be achieved by June 30, 2014.

4.

The ability to power the high pressure injection pumps from the PSW building would be achieved by June 30, 2014.

5.

The installation of the PSW pumps in place of the station auxiliary service water pump would be achieved by December 31, 2015. This had been listed as December 31, 2014, in the LAR.

6.

The completion of NFPA 805 Implementation Items 23, 32, and 43 from Table 2.9-1 of the December 29, 2010, license amendment would be achieved by June 30, 2016.

- 2 These items need to be completed for Oconee's fire protection program to be considered "fully implemented" and had been listed as December 31,2014, in the LAR.

The installation of the required additional fire detection would be delayed as follows:

Unit 1, December 31,2016; Unit 2, December 31,2017, Unit 3, July 31,2016. Delays in the fire detection modifications had not previously been requested in the July 31,2012 LAR.

The NRC staff expressed the opinion that these dates were significantly longer than the staff had thought the licensee could accomplish, and that a supplement to the LAR, with additional justification, would be needed. Duke stated that they would attempt to improve on these dates if possible, but believed that these were the dates they could commit to in a revised license condition. The NRC staff stated that we would have to have further discussions with NRC management.
