U.S. Nuclear Regulatory Commission December 14, 2012 Page 2 30 months plus the regulatory review period, which was committed in the Duke Energy letter dated October 17, 2011 (Ref. 3).

The NRC requested that it be advised of Duke Energy's preference as to whether to initiate the timeline now (September 20, 2012) or following the submission of the Flooding Hazard evaluation report.

In response to this request, Duke Energy prefers to initiate the timeline following the NRC approval of the Fukushima Flooding Hazard evaluation report and as requested, will submit the new flood modification design to the NRC and FERC concurrently.

Duke Energy is required to submit the ONS Fukushima Flooding Hazard evaluation report by March 12, 2013 to comply with the NRC 10 CFR 50.54(f Request for Information Regarding Recommendations 2.1, 2.4 and 9.3 of the Near-Term Task Force Review of Insights from the Fukushima Dai-ichi Accident. Duke Energy understands that the submission and subsequent NRC approval of the Fukushima Flooding Hazard Report will supersede the current January 28, 2011 Safety Evaluation that addressed external flooding concerns at Oconee Nuclear Station (Ref. 4).

This letter contains no regulatory commitments.

Since this letter contains Security Sensitive information, Duke Energy hereby requests the NRC to withhold it from public disclosure pursuant to 10 CFR 2.390(d)(1), "Public inspections, exemptions, requests for withholding."
