Dear Mr. Loeffler:

By letter dated October 30, 2012, (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML12307A433), Northern States Power Company - Minnesota, doing business as Xcel Energy, Inc., submitted a license amendment request (LAR) for the Monticello Nuclear Generating Plant (MNGP). The LAR proposes to revise Technical Specification (TS) 4.3.1, Fuel Storage Criticality, and TS 4.3.3, Fuel Storage Capacity, to reflect fuel storage system changes and a revised criticality safety analysis that addresses the legacy fuel types in addition to the new AREVA ATRIUMTM 10XM fuel design.

The purpose of this e-mail is to provide the final results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed change. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that there appears to be sufficient technical information, both in scope and depth, to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the LAR in terms of regulatory requirements and the protection of public health and safety and the environment.

The NRC staff anticipates the need for additional technical information regarding the Boral surveillance program at MNGP. The staffs expectations regarding surveillance programs for neutron absorbing materials in the spent fuel pool are described in NUREG-1801, Generic Aging Lessons Learned (GALL) Report, Revision 2, dated December 2012 (ADAMS Accession No. ML103490041), Aging Management Programs,Section XI.M40, Monitoring of Neutron-Absorbing Materials other than Boraflex. The program described in the GALL Report meets the requirements set forth in 10 CFR Part 50, Appendix A, GDC 62, prevention of criticality in fuel storage and handling. The staff suggests that it would be prudent to further discuss the NRC staffs expectations for Boral surveillance early in its review process.
