Enclosure 1, page 8, Section 5.3 references the precedents where NRC has previously approved the similar LAR. Once the subject LAR goes through NRC approval process, this methodology will also be considered acceptable for Fermi 2. Please let me know if you have any further comments or concerns. My staff reviewed the documentation and provided the following comment:

This LAR seems acceptable, if the overlapping test provides an adequate basis for showing whether the valve could be opened under operational conditions.

Therefore, the State of Michigan supports the NRC decision to issue the license amendment.

Issuance of Fermi 2 - LAR - Modify TS Surveillance Requirements for Safety Relief Valves - ME7829 Mr. Yale, We are progressing towards issuance of the above LAR. The amendment replaces the current requirements in TS to verify a Safety Relief Valve (SRV) opens manually with alternate requirement which verifies that a SRV is capable of being opened. The licensee submitted the amendment on January 10, 2012 (ML120110140), as supplemented on July 6, 2012 (ML121910392). Please let us know if you have any comments. Thanks 2
