On Monday, December 3, 2012 at 2:00 PM Eastern Standard Time, this Board will hold a conference call regarding scheduling and management in this proceeding in light of a March 27, 2012 NRC Confirmatory Action Letter (CAL) issued to Southern California Edison Company (SCE), and the Commissions November 8, 2012 decision in CLI-12-20 referring to the Atomic Safety and Licensing Board Panel that portion of Friends of the Earths June 18, 2012 intervention petition challenging the CAL. In particular, the Commission directs (CLI-12-20, slip op. at 5) that a duly constituted Board consider whether: (1) the [CAL] issued to SCE constitutes a de facto license amendment that would be subject to a hearing opportunity under Section 189a [of the Atomic Energy Act]; and, if so, (2) whether the petition meets the standing and contention admissibility requirements of 10 C.F.R. § 2.309.
The call is expected to last no more than sixty (60) minutes. At or before noon on Friday, November 30, 2012, participants1 should e-mail the Licensing Boards law clerk, Onika 1 The participants in this conference call will be (1) counsel for petitioner, Friends of the Earth, (2) counsel for amicus curiae supporting petitioner, Natural Resources Defense Council, (3) counsel for respondent, Southern California Edison Co., and (4) counsel for the NRC Staff.
Williams, at Onika.Williams@nrc.gov, to obtain the telephone number and pass code for the December 3 teleconference. The Board asks that all participants call into the teleconference a few minutes before the conference is scheduled to begin so that it commences promptly. Only the designated representatives of the parties may participate in the conference call.
In the event that a participant desires to have the conference monitored by a person or persons at a different location, upon request, Ms. Williams will make a reasonable number of additional telephone lines available for that purpose.2 The conference will be transcribed, and the transcript will promptly be placed in the NRCs electronic docket, where it may be freely accessed by the public.
