This letter informs the Board that the NRC Staff has revised the schedule for completion of the environmental review in this proceeding. The attached letter from Melanie Galloway, Acting Director, Division of License Renewal, Office of Nuclear Reactor Regulation, to Michael P.

Gallagher, Vice President License Renewal Projects, Exelon Generation Company, LLC, explains that the date for completion of the environmental review is to be determined while the Staff ensures that the Draft Environmental Impact Statement is consistent with the Commissions directions on waste confidence. The attached letter recognizes that the Commission has directed the Staff to proceed with ongoing reviews of license applications and indicates that the Staff will issue a revised environmental review schedule, with estimated completion dates, as soon as possible.

REVISION OF SCHEDULE FOR THE CONDUCT OF ENVIRONMENTAL REVIEW OF THE LIMERICK GENERATING STATION, UNITS 1 AND 2 LICENSE RENEWAL APPLICATION

Dear Mr. Gallagher:

By letter dated June 22,2011, Exelon Generation Company, LLC (Exelon) submitted an application pursuant to Title 10 of the Code of Federal Regulations, Part 54 (10 CFR Part 54), to renew Operating License NPF-39 and NPF-85 for Limerick Generating Station, Units 1 and 2 (LGS) for review by the U.S. Nuclear Regulatory Commission (NRC or the staff). This letter is to inform you about a schedule change in the LGS license renewal review.

The staff recognizes that final issuance of the renewed Limerick operating license must await the agency's response to a recent remand from the United States Court of Appeals for the District of Columbia regarding the agency's waste confidence rule update (10 CFR Part 51.23).

Nonetheless, the Commission has authorized the staff to proceed with its environmental and safety reviews of license applications in the interim. Consequently, the staff will continue both its safety and environmental reviews of the Limerick license renewal application while the agency formulates its response to the waste confidence remand. Because the Draft Supplemental Environmental Impact Statement ("DSEIS") for Limerick discusses issues related to waste confidence, the staff will need additional time to ensure that the DSEIS is consistent with the Commission's directions on waste confidence. Hence, until the staff completes this process, the components of the schedule related to the environmental review are temporarily to be determined (TBD). As soon as possible, the Staff will issue a revised schedule that provides estimated completion dates for the environmental review. If the agency's ultimate resolution of the remanded waste confidence issues further impacts the analysis in the DSEIS or the Final Supplemental Environmental Impact Statement, the staff may issue a supplemental Environmental Impact Statement as appropriate. Such a supplement may further affect the staff's review schedule.

The schedule has been updated to reflect a change in the date (Le., TBD) for the issuance of the Draft Supplemental Environmental Impact Statement and the subsequent environmental review milestones.
