Acceptance of Cooper LAR To Revise the Physical Protection License Condition as it Relates to the Cyber Security Plan (ME8895)

Date: Monday, July 16, 2012 12:21:00 PM Ed, By letter dated June 14, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12187A187), Nebraska Public Power District (NPPD) requested an amendment to the Facility Operating License for the Cooper Nuclear Station (CNS) to revise the Physical Protection license condition as it relates to the cyber security plan. By letter dated July 27, 2011, (ADAMS Accession No. ML111801081), the NRC approved the cyber security plan and associated implementation schedule, and revised Paragraph 2.C.(3) of Renewed Facility Operating License No. DPR-46 to provide a license condition to require the licensee to fully implement and maintain in effect all provisions of the NRC-approved Cyber Security Plan. NPPD is planning to implement the requirements of Implementation Milestone 6 in a slightly different manner than described in the approved Implementation Schedule.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
