RESPONSE TO CORRECTIVE ACTIONS FOR WATTS BAR UNIT 2 NOTICE

OF VIOLATION (NOV)05000391/2010603-08

Dear Mr. Skaggs:

Thank you for Tennessee Valley Authoritys (TVAs) participation in the public meeting held by

the Office of Nuclear Reactor Regulation (NRR) on October 14, 2011, concerning TVAs

corrective actions associated with Notice of Violation 05000391/2010603-08, Failure to

Adequately Evaluate and Qualify Molded Case Circuit Breakers.

After further review, the NRC has found that the corrective actions for the violation described in

the revised response letter dated June 9, 2011, (ML 11164A141) are inadequate to achieve full

compliance with the design control requirements of 10 CFR 50, Appendix B Criterion III. A Task

Interface Agreement (TIA) requested that NRR evaluate the bases for the conclusions reached

during a corrective action inspection the week of June 27, 2011, in which Region II inspectors

determined that TVA had not implemented adequate actions to close the NOV.

The NRR staff, in their response to the TIA (ML12109A428), evaluated TVAs compliance with

the requirements in Section 6.4, Device Testing, of Institute of Electrical and Electronics

Engineers Standard (IEEE) 344-1975. In addition, NRR evaluated TVAs configuration control

of the 120 VAC vital instrument power boards since its qualification in 1975, and TVAs analysis

of the most limiting seismic responses associated with the 120 VAC vital instrument power

boards. The NRR staff has determined that the Heinemann molded case circuit breakers were

not qualified in accordance with IEEE 344-1975 and has therefore concurred with Region II

inspectors that TVA has not implemented adequate corrective actions for the non-conforming

condition. Based on this evaluation, the NRC requests that TVA amend their response to the

Unit 2 violation with corrective actions that are sufficient to achieve full compliance with NRC

regulations in this matter. The NRC further requests that TVA include in the response any

short-term operability and long-term corrective actions necessary pursuant to this issue at both

WBN Unit 1 and Sequoyah Units 1 and 2. These should specifically address how configuration

control has been verified for these components and how applicable IEEE standards are being

met for all known Heinemann molded case circuit breaker configurations in safety-related

applications.

Pursuant to the provisions of 10 CFR 2.201, Tennessee Valley Authority is hereby required to

submit a supplemental response to this NOV to the U.S. Nuclear Regulatory Commission,

ATTN: Document Control Desk, Washington, DC 20555-0001 with a copy to the Regional

Administrator, Region II, and a copy to the NRC Resident Inspector at the facility that is the

subject of the Notice, within 30 days of the date of this letter. This reply should be clearly

marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the

reason for the violation, (2) the corrective steps that have been taken and the results achieved,

(3) the corrective steps that will be taken, and (4) the date when full compliance will be

achieved. Your response may reference or include previous docketed correspondence, if the

correspondence adequately addresses the required response. If an adequate reply is not

received within the time specified in this Notice, an order or a Demand for Information may be

issued as to why the construction permit should not be modified, suspended, or revoked, or why

such other action as may be proper should not be taken. Where good cause is shown,

consideration will be given to extending the response time.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and your

response will be available electronically for public inspection in the NRC Public Document Room

or from the Publicly Available Records (PARS) component of the NRCs document system

(ADAMS). Adams is accessible from the NRC Web site at http://www.nrc.gov/reading-

rm/adams.html (the Public Electronic Reading Room). Because your response will be made

available electronically for public inspection, to the extent possible, it should not include any

personal privacy, proprietary, or safeguards information so that it can be made available to the

public without redaction. If personal privacy or proprietary information is necessary to provide

an acceptable response, then please provide a bracketed copy of your response that identifies

the information that should be protected and a redacted copy of your response that delete such

information. If you request withholding of such material, you must specifically identify the

portions of your response that you seek to have withheld and provide in detail the bases for your

claim of withholding (e.g., explain why the disclosure of information will create an unwarranted

invasion of personal privacy or provide the information required by 10 CFR 2.390(b) to support a

request for withholding confidential commercial or financial information). If safeguards

information is necessary to provide an acceptable response, please provide the level of

protection described in 10 CFR 73.21.
