April 24, 2012 Mr. Dario Brisighella, President Aerotest Operations, Inc.

SUBJECT:
AEROTEST OPERATIONS, INC.,SCHEDULE FOR SUBMISSION OF LICENSE TRANSFER APPLICATIONOPERATING LICENSE NO. R-98, AEROTEST RADIOGRAPHY AND RESEARCH REACTOR
Dear Mr. Brisighella:
The purpose of this letter is to confirm the understanding of the U.S. Nuclear Regulatory Commission (NRC) staff regarding the schedule for submission of a transfer application for the Aerotest Radiography and Research Reactor (ARRR) Facility Operating License No. R-98.
On March 30, 2012, Aerotest Operations, Inc. (Aerotest or the licensee), submitted a letter to the NRC concerning Aerotests proposed transfer of the ARRR license to Nuclear Labyrinth LLC. The letter states that Aerotests schedule for submitting a license transfer application to the NRC is on or before May 30, 2012.
On April 4, 2012, NRC received a letter from Nuclear Labyrinth LLC, signed by Dr. David M.
Slaughter, CEO, stating that a date certain for this transaction has not been determined, although it is expected to occur on or before September 30, 2012.
The NRC staff held a telephone call with Aerotest on April 12, 2012, to discuss the apparent discrepancy between the Aerotest and Nuclear Labyrinth LLC letters in the date that NRC would receive a license transfer application for transfer of the ARRR facility operating license from Aerotest to Nuclear Labyrinth LLC. During that conversation you stated that the date of May 30, 2012, as stated in Aerotests March 30, 2012, letter is the correct date.
Therefore, the NRC staff expects to receive the application for transfer no later than May 30, 2012. If you have any questions about license transfers, please contact Mr. Spyros Traiforos at 301-415-3965.
Sincerely,
/RA/
