In its letter to the Nuclear Regulatory Commission ("NRC") of January 24, 2012 in this docket, Aerotest Operation Inc, ("Aerotest") stated that by March 30, 2012, it would submit to the NRC either (1) a notice that negotiations for the sale of the Aerotest Radiography and Research Reactor ("ARRR") have ended, or (2) a schedule for submitting a license transfer application to the selected offeror.

As Aerotest indicated during the conference call this morning with members of the NRC Staff, Aerotest has selected a proposed transferee for the ARRR. The proposed transferee is Nuclear Labyrinth LLC, whose principal is Dr. David M. Slaughter. Among his other positions, Dr. Slaughter is currently Research Professor, Nuclear Radiation Center, Washington State University. He has decades of experience with research and test reactors. To meet the commitment in the January 24, 2012 letter, and as Aerotest informed the NRC Staff during the conference call, Aerotest's schedule for submitting a license transfer application is on or before May 30, 2012.

In addition to the commitments set forth in its letter of January 24, 2012, the NRC Staff during the course of this morning's conference call requested that by April 6, 2012, Aerotest provide a written commitment from Dr. Slaughter that he is in negotiations with Aerotest to take over the NRC license for the ARRR. Aerotest agreed to do so.

As stated in my letter of March 20, 2012, with the selection of a potential purchaser and providing a schedule for submitting a license transfer application, we no longer see the need for the biweekly letters that Aerotest has been submitting to the NRC. Aerotest therefore intends to discontinue them.
