NRC Office of Investigations Assist-to-Staff at the James A. FitzPatrick Nuclear Power Plant
Dear Mr. Colomb:
The Region I Field Office, NRC Office of Investigations (OI), initiated an Assist-to-Staff (1-2011-054F) on August 24, 2011, based on information that Entergy supplied to the NRC. Specifically, FitzPatrick security personnel discovered a contractor who had reported to FitzPatrick for initial access screening with a concealed urine specimen on his person, allegedly at the suggestion of an employee from Nine Mile Point Nuclear Station.
OI determined that the contractor, who had never worked at a nuclear power plant, was aware of the potential for drug testing during the initial screening process. The contractor admitted during interviews with OI that approximately three days before reporting to FitzPatrick for initial screening, the contractor urinated in a bottle and froze it prior to using an illegal substance. The contractor advised that the sample was frozen so that a clean sample would be available in the event the contractor was chosen for random drug testing. The contractor further testified that he/she did it without any additional knowledge or information from an employee working in the nuclear industry.
The NRC staff reviewed this matter, with assistance from OI, and determined that you identified the bogus sample that the contractor attempted to bring into the sites protected area, that he/she planned to use to circumvent your Fitness for Duty process, that you prevented any access by the contractor to the site, and that you placed the contractor in PADS (Plant Access Database System). In consideration of the circumstances associated with this matter and based on the actions taken by your staff, the NRC plans no further action on this matter.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
