Vice President

  • Energy, Oconee Nuclear Station Duke Energy ON01 VP / 7800 Rochester Hwy.

Seneca, SC 29672 864-873-4478 864-873-4208 fax T.Gillespie@duke-energy.com December 9, 2011 U.S. Nuclear Regulatory Commission Attn: Document Control Desk Washington, DC 20555-0001

Subject:

Duke Energy Carolinas, LLC Oconee Nuclear Station, Units 1, 2, and 3 Docket Numbers 50-269, 50-270, and 50-287 Renewed Operating Licenses DPR-38, DPR-47, and DPR-55 Letter of Withdrawal of the Proposed Technical Specification Amendment Regarding Control Room Envelope Habitability In Accordance With TSTF-448 License Amendment Request No. 2010-07 Ref.: Duke Energy Carolinas, LLC (Duke Energy) letter to U.S. Nuclear Regulatory Commission, "Application to Revise Technical Specifications Regarding Control Room Envelope Habitability in Accordance with TSTF-448, Revision 3, using the Consolidated Line Item Improvement Process; License Amendment Request No.

2010.07," dated October 13, 2011.

In the referenced letter, Duke Energy submitted License Amendment Request (LAR) 2010-07, regarding modification of the Oconee Nuclear Station (ONS) Technical Specifications (TS) that involve control room habitability. The proposed change, if approved, would have incorporated Technical Specification Task Force (TSTF)-448, "Application to Revise Technical Specifications Regarding Control Room Envelope Habitability in Accordance with TSTF-448, Revision 3, using the Consolidated Line Item Improvement Process," into the ONS TS. However, some discrepancies have been identified such that withdrawal of the LAR is deemed appropriate.

Therefore, this letter requests ONS LAR 2010-07 be withdrawn from NRC consideration.

If there are any questions regarding this letter, please contact Mr. Kent Alter, ONS Regulatory Compliance Manager, at (864) 873-3255.

Sincerely, T. Preston Gillespie. Jr.,

Vice President, Oconee Nuclear Station www. duke-energy. corn wka(o
