Dear Mr. Ajluni:
By letter dated October 24, 2011, as supplemented by letter October 27, 2011, Southern Nuclear submitted a request for relief from the requirements of the ASME Code in order to effect a temporary non-Code repair of Service Water piping for the E.I. Hatch nuclear power plant U/1. The proposed relief request, if approved, would allow the temporary non-Code repair to be used until such point as the Service Water piping to the facility could be taken out of service and a full Code repair performed. You proposed that the alternative will remain in effect until an ASME Section XI Code repair or replacement is performed during the Hatch U/1 R25 refueling outage or until the next cold shutdown of sufficient duration to perform the repair or replacement, whichever occurs first.
The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the request has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
The NRC staff has reviewed your request and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified in requests for additional information despite completion of an adequate acceptance review.
