DPR-32, 37 NPF-4, 7 SNM-2501, 2507 VIRGINIA ELECTRIC AND POWER COMPANY NORTH ANNA POWER STATION UNITS 1 AND 2 AND ISFSIs SURRY POWER STATION UNITS 1 AND 2 AND ISFSIs PROPOSED EMERGENCY ACTION LEVEL REVISIONS In accordance with the provision of 10 CFR 50.90, Virginia Electric and Power Company (Dominion) is submitting a license amendment request to change the Emergency Action Levels (EALs) for North Anna Power Station (NAPS) and Surry Power Station (SPS).

Several changes are proposed to incorporate lessons learned from the safety related breaker fire that occurred at NAPS on April 22, 2009 (Ref. NRC Event Notification 45013). The proposed changes are briefly summarized as follows: 1) revise the definition of "Affecting Safe Shutdown" in the EAL Technical Basis Documents to specifically describe how this applies to NAPS and SPS; 2) revise applicable Hazards EALs to incorporate the intent of the revised definition for "Affecting Safe Shutdown"; in addition, the main dam is added to the Initiating Condition (IC) for HA1 for NAPS and the low level intake structure is added to the IC for HA1 for SPS; 3) changing the IC for HA2 and HA3 to replace "a safe shutdown area" with "any Table H-1 Area"; and 4) revise applicable System Malfunctions EAL to include a 15-minute threshold for RCS leaks.

These changes require prior approval by the NRC before implementation under provisions of 10 CFR 50.54(q) because they introduce a deviation as defined in Regulatory Issue Summary 2003-18, "Use of Nuclear Energy Institute (NEI) 99-01, Methodology for Development of Emergency Action Levels," Revision 4, dated January 2003, Supplement 2, dated December 12, 2005. That is, an EAL is altered such that classification of the event could be different than the site-specific EAL approved by the NRC and documented in NRC Safety Evaluation Report (SER); in this case, NRC's SER dated February 4, 2008.

The changes to the definition of Affecting Safe Shutdown and the Hazard EALs were reviewed with NRC staff on December 6, 2010.

The proposed changes do not involve a Significant Hazards Consideration pursuant to the provisions of 10 CFR 50.92. The proposed changes have also been reviewed by each station's Facility Safety Review Committee. These changes have been discussed with and agreed to by the Commonwealth of Virginia and local governmental authorities in the risk jurisdictions around NAPS and SPS.

Dominion requests that review of this request be performed by October 3, 2012. Upon receipt of approval of the proposed changes, we will revise the EALs for NAPS and SPS to implement the revised classification criteria within 120 days.
