INDIAN POINT NUCLEAR GENERATING UNIT NOS. 1. 2, AND 3 - REQUEST FOR ADDITIONAL INFORMATION REGARDING APPLICATION FOR PREEMPTION AUTHORITY (TAC NOS. ME6164 AND ME6165)

Dear Sir or Madam:

By letter dated April 27, 2011, Entergy Nuclear Operations. Inc. (Entergy) submitted an application for preemption authority pursuant to Section 161A of the Atomic Energy Act. as amended, for Indian Point Nuclear Generating Unit Nos. 1. 2, and 3. The preemption authority would allow the use of certain weapons by the security personnel at the Indian Point site.

The Nuclear Regulatory Commission staff is reviewing the submittal and has determined that additional information is needed to complete its review. The specific question is found in the enclosed request for additional information (RAt). The Entergy staff stated that a response to the RAI would be provided within 30 days of the date of this letter.

REGARDING PREEMPTION AUTHORITY ENTERGY NUCLEAR OPERATIONS. INC.

INDIAN POINT NUCLEAR GENERATING UNIT NOS. 1. 2, AND 3 DOCKET NOS.50-003, 50-247, AND 50-286 By letter dated April 27, 2011 (Agencywide Documents Access and Management System Accession No. ML11124A075), Entergy Nuclear Operations, Inc. (Entergy) submitted an application for preemption authority pursuant to Section 161A of the Atomic Energy Act, as amended, for Indian Point Nuclear Generating Unit Nos. 1, 2, and 3. The preemption authority would allow the use of certain weapons by the security personnel at the Indian Point site.

The Nuclear Regulatory Commission (NRC) staff is reviewing the submittal and has determined that additional information is needed to complete its review. The specific question is found below.

Describe the impact on Indian Point's current physical protection program and capabilities, including response capabilities, if the NRC were to elect not to grant stand alone preemption authority to Indian Point.
