RE: Salem Hope Creek Biological letter Dennis and Charles, I'm trying to figure out how to modify the Salem Hope Creek biological letter to meet the requirements of the Magnuson-Stevens Act.

This is what the Salem/Hope Creek letter currently says:

To support the SEIS preparationprocess and to ensure compliance with Section 7 of the Endangered Species Act, the NRC requests a list of species and information on protected, proposed, and candidate species and critical habitat that may be within the vicinity of Salem and Hope Creek and its associated transmissionline right-of-way. In addition, please provide any information you considerappropriate 32

under the provisions of the Fish and Wildlife CoordinationAct. To support the project schedule, we request that this information be transmitted by January20, 2010.

This is the corresponding section from the Indian Point letter to NOAA (NMFS):

To support the SEIS preparationprocess and to ensure compliance with Section 7 of the Endangered Species Act, the NRC requests a list of endangered,threatened, candidate,and proposedspecies, and designated and proposed critical habitat under the jurisdiction of the NationalMarine FisheriesService that may be in the vicinity of the OCNGS site and its transmissionline corridors. The most recent formal consultation for the continued operation of OCNGS was completed on September 22, 2005.

However, this letter requesting consultationrelated specifically to the NRC's review of AmerGen's license renewal applicationfor OCNGS In addition,please provide any information you consider appropriateunder the provisions of the Fish and Willife CoordinationAct. Also, in support of the SEIS preparationand to ensure compliance with Section 305 of the Magnuson-Stevens Fishery Conservationand Management Act, the NRC requests a list of essential fish habitat that has been designated in the vicinity of the OCNGS site and its associatedtransmission line corridors.

Here is my proposed update to the Salem/Hope Creek letter:

Salem Hope Creek Biological letter Dennis, Charles Eccleston asked me to have you, as a biological expert, review the Salem Hope Creek biological scoping/consultation letters which will be sent out to various agencies asking for their input about the relicensing of Salem and Hope Creek.

I put the package on your chair. It is basically 6 identical letters.. .the only difference between them is the addressees. It is marked up with some minor edits by Charles so if you have any other changes, please add them as well and let me know when you have finished and I will bring it back to the secretaries for further processing.
