Salem Hope Creek
- Caroline, Here is the verbage for the letter to Patricia Kurkul (Salem Hope Creek bio letter).
Also, can you please add Dennis Logan to the distribution list for all of these bio letters (the one going to Kurkul and the others, too).

RE: Salem Hope Creek Biological letter
- Dan, That should do. By the way, your example is from Oyster Creek, not Indian Point.

RE: Salem Hope Creek Biological letter Dennis and Charles, I'm trying to figure out how to modify the Salem Hope Creek biological letter to meet the requirements of the Magnuson-Stevens Act.
This is what the Salem/Hope Creek letter currently says:
To support the SEIS preparation process and to ensure compliance with Section 7 of the Endangered Species Act, the NRC requests a list of species and information on protected, proposed, and candidate species and critical habitat that may be within the vicinity of Salem and Hope Creek and its associated transmission line right-of-way. In addition, please provide any information you consider appropriate 32
under the provisions of the Fish and Wildlife Coordination Act. To support the project schedule, we request that this information be transmitted by January 20, 2010.
This is the corresponding section from the Indian Point letter to NOAA (NMFS):
To support the SEIS preparation process and to ensure compliance with Section 7 of the Endangered Species Act, the NRC requests a list of endangered, threatened, candidate, and proposed species, and designated and proposed critical habitat under the jurisdiction of the National Marine Fisheries Service that may be in the vicinity of the OCNGS site and its transmission line corridors. The most recent formal consultation for the continued operation of OCNGS was completed on September 22, 2005.
However, this letter requesting consultation related specifically to the NRC's review of AmerGen's license renewal application for OCNGS In addition, please provide any information you consider appropriate under the provisions of the Fish and Willife Coordination Act. Also, in support of the SEIS preparation and to ensure compliance with Section 305 of the Magnuson-Stevens Fishery Conservation and Management Act, the NRC requests a list of essential fish habitat that has been designated in the vicinity of the OCNGS site and its associated transmission line corridors.
Here is my proposed update to the Salem/Hope Creek letter:
To support the SEIS preparation process and to ensure compliance with Section 7 of the Endangered Species Act, the NRC requests a list of endangered, threatened, candidate, and proposed species, and designated and proposed critical habitat under the jurisdiction of the National Marine Fisheries Service that may be in the vicinity of the Salem and HCGS sites and their transmission line corridors.
In addition, please provide any information you consider appropriate under the provisions of the Fish and Willife Coordination Act. Also, in support of the SEIS preparation and to ensure compliance with Section 305 of the Magnuson-Stevens Fishery Conservation and Management Act, the NRC requests a list of essential fish habitat that has been designated in the vicinity of the Salem and HCGS sites and their associated transmission line corridors.
Please let me know if you agree with this revision or have any other changes.

- Dennis, Do you have a sample letter including the verbage regarding the Magnuson-Stevens Act? Charles would like to include this in the letter to NMFS.
- Thanks, 33

Salem Hope Creek Biological letter
- Dennis, Charles Eccleston asked me to have you, as a biological expert, review the Salem Hope Creek biological scoping/consultation letters which will be sent out to various agencies asking for their input about the relicensing of Salem and Hope Creek.
I put the package on your chair. It is basically 6 identical letters...the only difference between them is the addressees. It is marked up with some minor edits by Charles so if you have any other changes, please add them as well and let me know when you have finished and I will bring it back to the secretaries for further processing.
Thank you!
