ME6730 - Duane Arnold 2011 Audit of Regulatory Commitment Management - Request for Additional Information In Regulatory Issue Summary 2000-17, AManaging Regulatory Commitments Made by Power Reactor Licensees to the NRC Staff,@ dated September 21, 2000, the U.S. Nuclear Regulatory Commission (NRC) informed licensees that the Nuclear Energy Institute (NEI) document NEI 99-04, AGuidelines for Managing NRC Commitment Changes,@ contains acceptable guidance for controlling regulatory commitments and encouraged licensees to use the NEI guidance or similar administrative controls to ensure that regulatory commitments are implemented and that changes to the regulatory commitments are evaluated and, when appropriate, reported to the NRC.

The NRC Office of Nuclear Reactor Regulation has instructed its staff to perform an audit of licensees commitment management programs once every 3 years to determine whether the licensees programs are consistent with the industry guidance in NEI 99-04, and that the regulatory commitments are being effectively implemented.

The last regulatory commitment audit for Duane Arnold Energy Center was conducted on October 30 and 31, 2008, and was documented in a Letter from the NRC dated December 18, 2008 (ADAMS Accession No. ML083460261) The work was conducted under Task Assignment Completion (TAC) No. 6021.

I will be conducting the 2011 Regulatory Commitment (RgCm) Audit during the week beginning October 10, 2011.

The scope of the audit will be to select 20 RgCm in effect during the period from November 1, 2008 to present, based on the following criteria:

RgCm made as a result licensing actions (amendments, relief requests, and exemptions), and RgCm made as result of the license renewal process, and RgCm reported as changed (specifically the change to CR01621097, reported in your letter NG 0201, dated June 8, 2011 (ADAMS Accession No. ML111590889), Report of Facility Changes, Tests and Experiments, Fire Plan Changes, and Commitment Changes, and RgCm that were open at the time of the last audit and have since been closed, and RgCm that may be of specific interest to your or NRC staff.

I request the following information to support the RgCm audit:

1 - A list of RgCm that satisfy the above criteria. Commitments contained in the Safety Evaluation Report related to license renewal (NUREG-1955, ADAMS Accession No. ML103070013) are already identified and may be excluded from your response if you wish to do so and so state.

2 - A copy of the procedures in effect from November 1, 2008, to present, which are or were used to manage the RgCm. This includes processes for creation, change, implementation, closure, measures taken by which RgCm implementations are protected from unintended changes or removals.

3 - Internal audit findings and responses concerning RgCm management.

4 - For those RgCm that have been closed or changed during the period of the audit, evidence of the accomplishment or change. This can be: (1) a record of the accomplishment, (2) specific effect in a affected document, (3) revision history information, or (4) observation during an escorted visit to a plant location - if practical.

In the case of requested documentation, searchable electronic documents such as in Word or pdf format are preferred but not required. Please contact me if a request presents an unusual burden or risk to the document, such as an odd size (a D size drawing, for example), challenging format (white lines on colored background or pale lines on white background), or vintage records (original records, possibly in delicate condition). In most cases I am interested in the specific information, but do not wish to disturb the condition or bindings.

Regarding a working space at your location, please select a room with computer access, if practical, and space for intended records and seating if I need to talk to someone. The preferred location would be outside of the protected area and with minimal escort burden. The space should be convenient to whomever is assigned to move records that I would need. I would want to discuss your computer security needs relative to any restrictions with which I need to cooperate.
