UNIVERSITY OF FLORIDA - REGULATORY AUDIT FOR DIGITAL INSTRUMENTATION AND CONTROL LICENSE AMENDMENT REQUEST (TAC NO. ME3482)

Dear Dr. Hintenlang:

By letter dated February 17, 2010, (Agencywide Document Access and Management System (ADAMS) Accession No. ML100550693) the University of Florida (UF) submitted a license amendment request (LAR) for a digital Instrumentation and Control (I&C) upgrade for the University of Florida Training Reactor (UFTR). This application was supplemented by letters dated March 11, April 12, July 8, and August 11, 2010 (ADAMS Accession Nos. ML100710785, ML101050345, ML101950364, and ML102250416, respectively).

The U.S. Nuclear Regulatory Commission (NRC) staff will conduct an onsite regulatory audit to review the UFTR digital I&C license amendment application on August 3-5, 2011. The intent of the audit is to gain understanding of your application and status of your facility. In addition, the regulatory audit will identify information that will be required to be docketed in order to support the basis of the licensing decision and will allow the NRC staff to more efficiently gain insights on the UFTRs software development programs and processes. The NRC staff has provided an audit schedule, a list of personnel and their assignments participating in the audit, and a list of information and other material necessary for the regulatory audit in the enclosure.

At the completion of the regulatory audit, a regulatory audit summary will be prepared and provided to UF. UF will have the opportunity to modify and supplement the application to provide additional information or the option to withdraw the application. We request that UF notify the NRC in writing within 30 days of the issuance of the audit summary of their intent to correct any identified deficiencies or formally withdraw the LAR as applicable. If UF does not respond within the specified time, the amendment could be denied in accordance with Title 10 of the Code of Federal Regulations Section 2.108, Denial of application for failure to supply information. If UF chooses to withdraw the application or the application is denied due to an identified deficiency in the submittal (as opposed to a definitive negative finding by the NRC staff based on the technical merits of the proposed changes), UF may submit a new application (with the identified discrepancies corrected) in the future.
