COMMITMENT TO SUBMIT A LICENSE AMENDMENT REQUEST TO TRANSITION TO 10 CFR 50.48(c), NATIONAL FIRE PROTECTION ASSOCIATION STANDARD NFPA 805, AND REQUEST TO EXTEND ENFORCEMENT DISCRETION - BEAVER VALLEY POWER STATION, UNIT NOS. 1 AND 2; DAVIS-BESSE NUCLEAR POWER STATION, UNIT NO.1 (TAC NOS. ME6628, ME6627 AND ME6613)

Dear Mr. Sena:

By letter to the U.S. Nuclear Regulatory Commission (NRC, the Commission) dated June 29, 2011, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML111800765), the FirstEnergy Nuclear Operating Company (1) committed to submit a license amendment request (LAR) for Beaver Valley Power Station, Unit Nos.1 and 2 by September 30, 2012, and Davis-Besse Nuclear Power Station, Unit No.1 by July 1,2014, to transition to National Fire Protection Association Standard NFPA 805 in accordance with Title 10 of the Code of Federal Regulations 50.48(c), and (2) requested that enforcement discretion for fire protection issues be extended to correspond with the LAR submittal date.

The NRC staff has reviewed your letter and finds it consistent with Commission direction as provided in SRM-SECY-11-0061, dated June 10, 2011 (ADAMS Accession No. ML111610616).

Therefore, your request to extend enforcement discretion is granted in accordance with the Interim Enforcement Policy concerning Enforcement Discretion for Certain Fire Protection Issues as published in the Federal Register on July 12, 2011 (76 FR 40777).

If you are unable to meet the above LAR submittal date, you are requested to contact the NRC staff at least 90 days in advance. Please contact Michael Mahoney at (301) 415-3867 if you have any questions.
