This serves to confirm receipt of your recent email communication in connection with a 2.206 enforcement petition filed with the NRC related to operations at TVA and one of its associated nuclear power plants (Browns Ferry).

I disagree with the conclusion reached by the NRC as described in your email; however, I will wait to receive further correspondence as mentioned in your email prior to taking further action in this most serious matter.

Mr. Saporito, On June 21, 2011, I attempted to contact you by telephone regarding your petition to take enforcement action, dated June 4, 2011. This email is in response to your voicemail requesting that I convey any messages via email instead of by phone.

Your petition requests that the NRC take escalated enforcement action against the Tennessee Valley Authority and Mr. Thomas Kilgore, Chief Executive Officer, and suspend or revoke the NRC license granted to the licensee for operation of the Browns Ferry Nuclear Plant, and to issue a notice of violation with a proposed civil penalty against TVA and Mr. Kilgore.

The NRC staff has reviewed your request against the criteria for reviewing petitions in Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions. As indicated in MD 8.11, Part III, C.2.b, the staff will not review petitions where the issues already have been the subject of NRC staff review and evaluation, for which a resolution has been achieved, and the resolution is applicable to the facility in question. NRC staff has already

2 issued enforcement action for the issues discussed in your request, and your request did not identify any significant new information.

The staff will be sending you a closure letter which will provide the details of the staffs decision in the near future.
