There were no other 'takes' of terrestrial, avian, or aquatic wildlife subject to legal protection due to Diablo Canyon Power Plant operations during 2009. 2) DCPP Units 1 & 2 fish impingement has been determined to be very low (average approximately 2-3 pounds of fish biomass daily). Owners of power plants with a generating capacity of 1-MW or more shall submit copies of any written notification provided by any state or federal regulatory agency for the following:

1. Any violation of an applicable statute, regulation, or permit condition related to public health or environmental quality created by operation of the power plant during the previous calendar year, or for which there is an ongoing investigation regarding a potential violation at the time that the data identified in this subdivision is required to be filed with the Commission.

Notes: For DCPP Units 1 & 2 calendar year 2009: No (0) formal/finalized Notices of Violation (NOVs) were received related to environmental quality or public health. There is one (1) ongoing investigation involving a wastewater discharge exceedance during January 2009 preliminarily determined to meet the criteria of a State Mandatory Minimum Penalty (MMP) event. The event involved exceedance of the NPDES Permit Discharge Pathway 001P daily/monthly limitation for Total Suspended Solids (TSS). 001P is the waste water discharge for the facility Seawater Reverse Osmosis (SWRO) system brine reject and filter backwash blowdown.

The jurisdictional regulatory agency (Central Coast Regional Water Quality Control Board Region-3) has not to date issued a formal finding and penalty assessment.

ONCE THIS WAS CONFIRMED VIA MOS3 07DEC93 THE MAINTENANCE WORK CREWS, THE VOLUME MOS3 07DEC93 OF WATER REMOVED AND THE CONCENTRATION MOS3 07DEC93 OF RADIOACTIVE MATERIALS WAS RELATIVELY MOS3 07DEC93 EASY TO RECONSTRUCT.

MOS3 07DEC93 STATEMENTS FROM THE MAINTENANCE GROUP, MOS3 07DEC93 INCLUDING THE ENGINEER IN CHARGE OF THE MOS3 07DEC93 WORK INDICATED THAT LESS THAN 1/2 INCH MOS3 07DEC93 OF WATER WAS PRESENT ON THE CONTAMINATED MOS3 07DEC93 SIDE OF THE BLADDER. BASED ON VOLUME 9 MOS3 07DEC93 DATA (PAGE IE-16.3.A, ATTACHED), THIS IS MOS3 07DEC93 EQUAL TO ABOUT 402 GALLONS OF LIQUID. MOS3 07DEC93 PRESENT ON TOP OF THE BLADDER, ON THE MOS3 07DEC93"CLEAN" SIDE WAS ANOTHER SEVERAL INCHES MOS3 07DEC93 OF LIQUID. THIS VOLUME WAS ESTIMATED TO MOS3 07DEC93 BE ABOUT 2100 GALLONS. THE ENTIRE MOS3 07DEC93 VOLUME WAS MIXED TOGETHER BY CUTTING THE MOS3 07DEC93 BLADDER AND ALLOWING THE LIQUIDS FROM MOS3 07DEC93 OPPOSITE SIDES OF THE BLADDER TO CO- MOS3 07DEC93 MINGLE. THE RESULTANT MIXTURE OF MOS3 07DEC93 LIQUIDS WAS PUMPED FROM THE TANK TO THE MOS3 07DEC93 FLOOR DRAIN, WHICH WE NOW KNOW DUMPED MOS3 07DEC93 DIRECTLY TO THE PAVEMENT ON THE NORTH MOS3 07DEC93 SIDE OF THE BUILDING.
