Dear Mr. Saporito:

This is a follow up to my voice mail that I left for you today, regarding your 10 CFR 2.206 petition dated December 5, 2009, as supplemented by portions of your petition dated August 6, 2010, against Progress Energy, representing Florida Power Corporation (the licensee) at Crystal River Nuclear Generating Plant, Unit 3 (CR-3). In accordance with NRC management Directive 8.11, I would like to inform you that the issuance of the proposed directors decision has been extended to December 3, 2012. The extension is mainly because the information needed for a proposed directors decision is tied to completion of the licensees activities associated with the containment restoration and the NRCs evaluations of these actions.

By November 2010, the licensee had completed its containment repairs, and in January 2011, it began implementing retensioning the containment tendons. On March 14, 2011, when the licensee was in the final stages of containment retensioning, installed acoustic monitors and strain gages indicated a possible additional delamination in the containment building. Subsequent test results confirmed an additional delamination affecting a broad area of Bay 5-6. Due to occurrence of the 2nd delamination, the licensee stopped the containment restoration activities, including its planned integrated leak rate test (ILRT) and structural integrity test (SIT). Progress Energy is currently exploring potential paths forward and continues to evaluate the condition and possible repair options of the additional delamination. The licensee notified the NRC that CR-3 will remain out of service while the company conducts a thorough engineering analysis, and conducts repair/restoration activities for the new delamination. Options to return the plant to service are being analyzed and the licensee cannot estimate a return to service date for the plant at this time. However, the licensee has indicated that the repair/restoration of the new delamination will be more complex than the original delamination. On April 14, 2011, the petition review board (PRB) held an internal meeting to consider whether the Crystal River petition could be dispositioned given the new delamination. The PRB recommended to request an 18 month extension from the current due date, because preparation of a proposed Directors Decision is tied to the licensees activities regarding Crystal River containment repair and restart of the unit, including completion of the ILRT and SIT.
