Dear Ms. Carle:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your resolution regarding the Oyster Creek Nuclear Generating Station (Oyster Creek), dated April 26, 2011. This resolution was forwarded to the NRC and conveyed the township's resolution to urge the NRC to immediately close and decommission Oyster Creek based upon a number of cited concerns including general statements about deficiencies in safety features, functionality of radiation monitors and sirens, the age of the plant, leakage of tritium, and other radioactive emissions.
The NRC requires that Exelon Generation Company, LLC (the licensee) comply with all the conditions set forth in the license as well as all applicable NRC regulations. The NRC monitors licensee's performance through our Reactor Oversight Process (ROP), and documents our findings in inspection reports and other assessment documents. In our most recent assessment of Oyster Creek, the plant performance was within the Licensee Response Column of the NRC Action Matrix. This classification indicates that Oyster Creek has operated safely and merits regulatory attention consistent with our baseline inspection program. In addition, the NRC maintains resident inspectors on-site to monitor ongoing licensee activities to ensure adequate performance and compliance with NRC requirements. These inspectors provide valuable feedback on Exelon's performance to NRC management on a real-time basis.
The NRC requires plant operators to continually test and monitor the condition of safety equipment and to keep equipment in a functional condition. Further, the NRC requires licensees to identify and correct, in an appropriate time-frame, any conditions and design deficiencies that could impact plant safety. The licensee is implementing an aging management plan to address the effects of operation past its initial license term, which should address your concern of operation longer than 40 years. The NRC has previously reviewed this plan and found it to be acceptable.
