Subject:

Duke Energy Carolinas, LLC (Duke Energy)

McGuire Nuclear Station, Units 1 and 2 Docket Nos. 50-369 and 50-370 Catawba Nuclear Station, Units 1 and 2 Docket Nos. 50-413 and 50-414 Request for Withdrawal of License Amendment Request to Revise Reactor Trip System and Engineered Safety Feature Actuation System Technical Specifications By letter dated June 29, 2010, Duke Energy submitted a License Amendment Request (LAR) for the McGuire Nuclear Station (MNS) Renewed Facility Operating Licenses and Technical Specifications (TS) and the Catawba Nuclear Station (CNS) Renewed Facility Operating Licenses and TS. The proposed LAR would revise the Reactor Trip System (RTS)

Instrumentation TS 3.3.1 and the Engineered Safety Feature Actuation System (ESFAS)

Instrumentation TS 3.3.2 for both MNS and CNS, to reflect the results of updated setpoint calculations.

In the course of preparing a response to a request for additional information received from the NRC staff, it was recognized that the setpoint calculations that form the basis of the LAR require further evaluation and may need to be revised. Hence, it is appropriate for Duke Energy to request that the LAR be withdrawn. Duke Energy intends to resubmit the LAR following completion of any necessary revisions to the setpoint calculations.

There are no regulatory commitments made in this submittal.

If there are any questions or if additional information is needed, please contact Mr. M. K. Leisure at (980) 875-5171.

Sincerely, Regis T. Repko
