Dear Mr. Shapiro:
You marked the subject letter as Confidential Information Submitted Under 10 CFR 2.390. However, no affidavit was submitted requesting NRC's determination if compelling reason for non disclosure exists, after balancing of the interests of the person... urging non disclosure and public interest in disclosure, pursuant to 10 CFR 2.390. Could you please submit an affidavit, pursuant to 10 CFR 2.390, seeking non disclosure of your January 6, 2011 letter. The NRC staff will evaluate your request, and advise you of the outcome.
