OF TELEPHONE CONFERENCE CALLS HELD ON MARCH 9 AND 11,2011, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND NATIONAL MARINE FISHERIES SERVICE CONCERNING ENTERGY'S REQUEST FOR EXTENDED ENDANGERED SPECIES ACT CONSULTATION RELATED TO THE PROPOSED INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 LICENSE RENEWAL The U.S. Nuclear Regulatory Commission (NRC or the staff) and National Marine Fisheries Service Staff (NMFS) held telephone conference calls on March 9 and 11, 2011, to discuss a response to Entergy's March 1, 2011, request for extended Endangered Species Act consultation related to the proposed license renewal of Indian Point Nuclear Generating Unit Numbers 2 and 3 (letter available at Agencywide Documents Access And Management System (ADAMS) Accession Number ML110670270). NMFS responded to the request by letter on March 16,2011 (ADAMS Accession Number ML110830578).

Enclosure 1 contains a participant for the March 9 and March 11 teleconferences, while Enclosure 2 contains a summary of the March 9 and March 11 teleconferences.

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) staff received a letter (Agencywide Documents Access and Management System (ADAMS) Accession Number ML110670270) and e-mail (ADAMS Accession Number ML110660673) from Entergy indicating that it wished to participate in the ongoing Endangered Species Act Section 7 consultation between NRC and the National Marine Fisheries Service (NMFS). Entergy indicated that it could provide additional information, and requested that NRC seek an agreement with NMFS for an extension of time to complete consultation, among other matters.

NRC provided NMFS with an overview of the consultation process to date, as well as the license renewal environmental review process to date. NRC and NMFS staff discussed possible avenues for Entergy's participation and whether an extension is an appropriate response.

NRC and NMFS agreed that Entergy will have an opportunity to submit information. NRC staff will communicate with NMFS to propose a specific timeline prior to the current consultation deadline of March 16, 2011.

Neither NRC nor NMFS objected to Entergy's involvement in the consultation process, given Entergy's role as applicant for license renewal.

SUMMARY

NRC staff contacted NMFS staff to discuss the proposed timing of an extended consultation under the Endangered Species Act in response to Entergy's request to participate in the consultation process.

NRC proposed a 60-day consultation extension. Consultation would close on May 14, 2011.

As Entergy's letter of March 1, 2011, suggests, Entergy would be able to submit its information to NRC on or before April 30, 2011. NRC staff will convey the information to NMFS as soon as possible thereafter, and NMFS will have an opportunity to review the information until the May 14 extended consultation deadline. Depending on the nature of the information, NMFS rnay request additional consultation time in order to review the data.

NMFS staff found the proposed timeline reasonable. NRC staff indicated that it would follow-up with an e-mail documenting the proposal (ADAMS Accession Number ML110730378), and NMFS indicated it would issue a consultation letter on or before March 16, 2011.

NRC staff and NMFS staff also discussed a possible meeting or teleconference in advance of Entergy's data submission, but did not establish a specific date or location.
