NRC STAFF'S ANSWER TO RIVERKEEPER, INC. AND CLEARWATER, INC.'S "CHALLENGE TO NRC STAFF'S ASSESSMENT OF IMPACTS OF SPENT FUEL POOL LEAKS IN THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT" INTRODUCTION Pursuant to 10 C.F.R. § 2.309(h)(1), and the Board's "Scheduling Order" of July 1, 2010, the Staff of the U.S. Nuclear Regulatory Commission ("Staff") files its answer to the "challenge,,1 submitted by Riverkeeper, Inc. ("Riverkeeper") and Clearwater, Inc. ("Clearwater").

on February 3, 2011, concerning the Staff's Final Supplement 38 to the "Generic Environmental Impact Statement for License Renewal of Nuclear Plants" ("GElS"), NUREG-1437 (May 1996),2 In their FSEIS Challenge, Riverkeeper and Clearwater (hereafter, "Joint Petitioners") request that Consolidated Contention Riverkeeper EC-3/ Clearwater EC-1 ("Consolidated Contention")

be applied to the Staff's Final SEIS. As set forth below, the Staff does not oppose this request.

- 2 DISCUSSION The Joint Petitioners assert that the FSEIS fails to address their concerns regarding spent fuel leaks, and that the discussion of these matters in the FSEIS is "substantially the same (and in fact, largely verbatim) as that in the DSEIS." FSEIS Challenge at 3. As the Joint Petitioners observe, earlier in these proceedings, Riverkeeper and Clearwater had challenged the Draft SEIS and requested that their previously admitted Consolidated Contention be applied to the DSEIS. 3 Neither Entergy nor the Staff opposed application of the Consolidated Contention to the DSEIS, 4 and the Board granted their request to apply the Consolidated Contention to the DSEIS.5 The Joint Petitioners therefore seek to have their Consolidated Contention applied to the Staff's FSEIS.

In view of the fact that the Board has previously admitted this contention and has applied it to the DSEIS, the Staff does not oppose Riverkeeper's and Clearwater's request that the Consolidated Contention be applied to the Staff's Final SEIS, as previously admitted. 6 3 Riverkeeper, Inc.'s Challenge to NRC Staffs Assessment of Impacts of Spent Fuel Pool Leaks in the Draft Supplemental Environmental Impact Statement (Feb. 27, 2009).

4 NRC Staff's Answer To Amended and New Contentions Filed by the State of New York and Riverkeeper, Inc. Concerning the Draft Supplemental Environmental Impact Statement, (Mar. 24, 2009);

Entergy's Consolidated Response to Riverkeeper's February and March 2009 Filings Concerning Consolidated Riverkeeper's EC-3/Clearwater's EC-1 and Riverkeeper Contention TC-2, (Apr. 6, 2009).

- 3 CONCLUSION For the foregoing reasons, the Staff does not oppose the Joint Petitioners' request that their Consolidated Contention (Riverkeeper EC-3/Clearwater EC-1) be applied to the Staff's Final SEIS.
