RESPONSE TO CORRECTIVE ACTIONS FOR NOTICE OF VIOLATION (NOV)05000391/2010603-08

Dear Mr. Bhatnagar:

Thank you for your letter dated November 24, 2010 (ML103300217), in which you admitted that a violation occurred and for the information you presented during our meeting of December 16, 2010 (ML103230195), concerning your corrective actions to address NOV 05000391/2010603-08 dated August 5, 2010. The NOV described a violation involving the failure to adequately qualify and evaluate Molded Case Circuit Breakers (MCCBs).

The corrective actions you prescribe for the violation do not appear to be adequate to achieve full compliance with the design control requirements of 10 CFFR 50, Appendix B Criterion III.

Your methodology appears to be based on a premise that the seismic testing of MCCBs does not need to simulate their actual configuration if they are rigidly mounted. To support your premise, you cited IEEE 344-1974 section 6.4, which addresses devices that are intended to be mounted on a panel, and further states that, The device may be mounted directly to the shake table if the in-service excitation can be simulated. Your calculation WCG-ACQ-1301 did not demonstrate that the clamped mounting configuration is rigid nor did it establish that IEEE 344 section 6.4 is applicable to the clamped mounting configuration of your MCCBs. Your use of section 6.4, in this case is in contradiction to section 6.1 of the same standard, which states in part, The equipment to be tested shall be mounted on the vibration generator in a manner that simulates the intended service mounting. Therefore, we request an amended response to the violation describing corrective actions that are sufficient for you to achieve full compliance.
