Heffley (CGG), dated May 31, 2006, Response to Letter of Intent to Adopt National Fire Protection Association (NFPA) Standard 805, Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2, and Nine Mile Point Nuclear Station, Unit Nos. 1 and 2 By letter dated April 17, 2006 (Reference a), Constellation Generation Group, LLC (CGG) indicated its intent to transition the fire protection licensing basis for Nine Mile Point Unit 2 (NMP2) to the voluntary alternative in 10 CFR 50.48(c) to adopt National Fire Protection Association (NFPA) Standard 805. By letter dated May 31, 2006 (Reference b), the NRC responded to Reference (a), noting that the enforcement discretion period would last for 3 years from the scheduled transition start date for each applicable CGG unit. For NMP2, the enforcement discretion period extends to May 1, 2011, based on the scheduled transition start date of May 1, 2008 stated in Reference (a).

Nine Mile Point Nuclear Station, LLC (NMPNS) has reconsidered the decision to transition NMP2 to NFPA 805. NMP2 has multiple trains of systems and equipment available to achieve a safe shutdown LW4L

Document Control Desk February 18, 2011 Page 2 condition following a fire and has a high degree of spatial and electrical train separation by design. Based on these design considerations, NMPNS has determined that it is appropriate to retain the existing NMP2 licensing basis of compliance with 10 CFR 50.48(a). Therefore, by this letter NMPNS is notifying the NRC that transition to 10 CFR 50.48(c) will not be completed for NMP2, and hereby withdraws the intent to voluntarily implement 10 CFR 50.48(c) stated in Reference (a).

NMPNS has not relied on the completion of the transition to 10 CFR 50.48(c) to resolve any fire-related issues of concern for NMP2. NMPNS is addressing circuit issues related to multiple spurious operations in accordance with the guidance provided in Regulatory Guide 1.189, "Fire Protection for Nuclear Power Plants," Revision 2, and Enforcement Guidance Memorandum 09-002, "Enforcement Discretion for Fire Induced Circuit Faults."

This letter contains no new regulatory commitments.
