SUBJECT: H. B. ROBINSON STEAM ELECTRIC PLANT - FINAL SIGNIFICANCE DETERMINATION REPORT 05000261/2011405

Dear Mr. Duncan:

This refers to the Nuclear Regulatory Commission=s (NRC) in-office inspection of the H. B. Robinson Steam Electric Plant, Unit 2, completed on January 28, 2011, for the licensee's failure to control the reproduction of safeguards information (SGI). The finding was preliminarily determined to have greater than very low security significance (i.e., greater than Green as determined by the Physical Protection Significance Determination Process), and an Apparent Violation was transmitted to you in NRC Inspection Report 05000261/2010402, dated November 10, 2010.

At your request, on December 15, 2010, a Regulatory Conference was conducted in the NRC's Region II office with members of your staff to discuss the Apparent Violation, its significance, root causes, and your corrective actions. At the conference, your staff provided details of its review of the matter that include an amended root cause analysis, corrective actions, and shared their view that the violation did not warrant escalated enforcement.

Based on this inspection, the NRC has identified two issues that were evaluated under the risk significance determination process as having very low safety significance (Green). The NRC has also determined that two violations are associated with these issues. The violations are being treated as Non-Cited Violations (NCVs), consistent with Section 2.3.2 of the NRC Enforcement Policy and are described in the subject inspection report. One violation had a cross-cutting aspect in the area of Human Performance under H.4.(c), in that, the licensee failed to ensure supervisory and management oversight of work activities, such that nuclear security is supported. If you disagree with the cross-cutting aspect or characterization of any finding in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the Regional Administrator Region II, and the NRC Resident Inspector at the H. B. Robinson Steam Electric Plant, Unit 2.

The NRC has concluded that information regarding the reasons for the violations, the corrective CP&L 2 actions taken or planned in order to correct the violations and prevent recurrence, and the date when full compliance was achieved, is already adequately addressed on the docket in the information presented by the H. B. Robinson Steam Electric Plant staff at the Regulatory Conference. Therefore, you are not required to respond to this letter unless the description herein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in this letter.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system, ADAMS. ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related concerns contained in the enclosure, and in accordance with 10 CFR 2.390, a copy of this letter=s enclosure will not be available for public inspection.
