Oconee Nuclear Station, Units 1, 2, and 3, Docket Nos. 50-269, 50-270, 50-287 McGuire Nuclear Station, Units 1 and 2, Docket Nos. 50-369, 50-370 Catawba Nuclear Station, Units 1 and 2, Docket Nos. 50-413, 50-414 2011 Nuclear Energy Liability Endorsements In accordance with 10 CFR 140.15, certified copies of liability insurance policy endorsements effective January 1, 2011 for each Duke Energy nuclear plant are submitted to the Commission to formally document that Duke Energy is maintaining financial protection requirements through the continuation of the American Nuclear Insurers / Nuclear Energy Liability Policies.

In accordance with 10 CFR 140.21, each Duke Energy operational power reactor participates in the industry retrospective rating plan as required by Section 170 of the Atomic Energy Act. Such participation is evidenced by certificate to the Master Policy in the custody of the NRC - Nuclear Energy Liability Insurance (Secondary Financial Protection), issued by American Nuclear Insurers

/ Nuclear Energy Liability Insurance Association. Duke Energy submits these Certified Endorsements to the Commission following the renewal of such certificates on January 1t of each year in accordance with Section 140.15(e) as described above.

Federal Register 72FR59574NoI. 72, No. 203/Monday, October 22, 2007/Notices, states:

The method described in Regulatory Guide 9.4 unnecessarily duplicates other financial and insurance verification documents submitted by the licensees to demonstrate compliance with other sections of 10 CFR part 140. Rather than submit separate cash flow and financial assurance statements, licensees may submit proof of sufficient insurance bonding through American Nuclear Insurers or similar insurance groups. This insurance bond meets the requirements of 10 CFR 140.21(a) and eliminates the need for a separate cash flow statement.

Based on the above described Federal Register notice, Duke Energy considers the submission of these Secondary Financial Protection Certified Endorsements to the Commission sufficient to satisfy its 10 CFR 140.21 reporting requirement.

Please advise immediately if the NRC ever determines that additional information is needed to demonstrate compliance with 1 OCFR1 40.21, "Annual reporting requirement of guarantee of payment of deferred premiums."
