MILLSTONE POWER STATION, UNIT NO. 3 -

POTENTIAL NOTICE OF ENFORCEMENT DISCRETION FOR THE TURBINE-DRIVEN AUXILIARY FEEDWATER PUMP (TAC NO. ME4543)

On August 23, 2010, Dominion Nuclear Connecticut, Inc. (DNC or the licensee) contacted the U.S. Nuclear Regulatory Commission (NRC) staff regarding a potential Notice of Enforcement Discretion (NOED) request for Millstone Power Station, Unit No. 3 (MPS3). The potential NOED would have requested the NRC to not take enforcement action during the time needed, beyond the time allotted by the MPS3 technical specifications (TSs), to complete repairs of the turbine-driven auxiliary feedwater (TDAFW) pump discharge relief valve.

During the TDAFW pump surveillance test the measured recirculation flow rate was determined to be outside of the acceptance range. The cause was determined to be leakage past the TDAFW pump discharge relief valve. Failure of the TDAFW pump surveillance requires MPS3 to enter a TS ACTION STATEMENT requiring MPS3 to restore the TDAFW to OPERABLE STATUS within 72 hours3 days <br />0.429 weeks <br />0.0986 months <br /> or to be in HOT STANDBY within the next 6 hours0.25 days <br />0.0357 weeks <br />0.00822 months <br /> and in HOT SHUTDOWN within the following 12 hours0.5 days <br />0.0714 weeks <br />0.0164 months <br />. DNC was not sure that repair of the TDAFW pump discharge relief valve could be completed in the remaining time.

Later on August 23, 2010, DNC informed the NRC staff that the TDAFW pump discharge relief valve repairs had been completed and the TDAFW pump had successfully passed the surveillance test. The successful test allowed MPS3 to exit the ACTION STATEMENT. Upon exiting the ACTION STATEMENT, DNC informed the NRC staff that they would not be requesting a NOED.

No NRC staff action was taken and no NRC decision was made regarding the potential NOED. This memorandum is to inform you that TAC No. ME4543 will be closed.
