Dear Ms. Varney,

The purpose of this letter is to transmit a request for consultation on antitrust information submitted by the Tennessee Valley Authority (TVA) as part of its application for an Operating License for the Watts Bar, Unit 2 facility, under section 103 of the Atomic Energy Act of 1954, as amended.1 Specifically, the information submitted by TVA addresses whether significant anticompetitive changes have occurred in its activities since the prior antitrust review conducted by the Nuclear Regulatory Commission (NRC) when it granted TVAs application for a construction permit to build the Watts Bar, Unit 2 facility.

The NRCs Office of the General Counsels staff attorneys have discussed this matter extensively with Ms. Janet Urban, an attorney in your Transportation, Energy, and Agriculture Section. I have attached all of the documents which she has indicated she will need to provide the NRC with an opinion on TVAs submittal. I have included these documents in paper and electronic versions, and we have also sent an e-mail to Ms. Urban with these documents attached.

Williamson Assistant General Counsel for Operating Reactors Office of the General Counsel 1 Pursuant to Section 105(c) of the Atomic Energy Act, the NRC must conduct a review on an application for an operating license to determine if significant changes have occurred in the applicants activities since the prior NRC antitrust review on the application for a construction permit. Historically, the NRC has consulted with the Attorney General on these determinations. 10 C.F.R. § 2.101(e) (2004).
