SUMMARY

OF JULY 15,2010 CONFERENCE CALL WITH FLORIDA POWER CORPORATION, ON NRC'S PRELIMINARY REVIEW OF FLORIDA POWER COPRORATION'S 10 CFR 50.59 EVALUATION (TAC NO. ME2372)

On July 15, 2010, a Category 1 public conference call was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Florida Power Corporation (the licensee, also known as Progress Energy) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the call was to discuss the licensee's Title 10 of the Code of Federal Regulations (10 CFR), Section 50.59 approach regarding Crystal River, Unit 3 containment delamination repair activities. A list of attendees is provided as an Enclosure.

To facilitate the call, the NRC provided a handout to the licensee (Agencywide Documents Access and Management System (ADAMS) Accession No. ML102030352). The NRC revised the original handout and used it as talking points by the NRC during the call (ADAMS Accession No. ML102030341). The revised handout was provided to the licensee after the conclusion of the call.

As background, the NRC staff previously held a public meeting with Progress Energy on June 30, 2010. Progress Energy made a presentation on repair activities regarding the Crystal River, Unit 3 containment delamination. During the meeting, the licensee stated that the repair activities will be implemented under 10 CR 50.59 per Nuclear Energy Institute (NEI) guidance, NEI-96-07, rev. 1. The licensee requested feedback from the NRC on its approach. To ensure the June 30, 2010, meeting objective and purpose were met, the NRC suggested having a separate public meeting to discuss Progress Energy's 10 CFR 50.59 evaluation repair approach.

During the JUly 15, 2010, public conference call, the licensee stated the purpose of the call was to understand the NRC issues with proceeding with the 10 CFR 50.59 evaluation. Also, the licensee expressed their desire to end the conversation with a good understanding of what needs to be included in the 10 CFR 50.59 evaluation. The call was turned back over to the NRC to present the information in the handout.

During the July 15th call, the NRC asked the licensee to briefly describe its approach for repair activities and the 10 CFR 50.59 evaluation. The licensee referenced the June 30th presentation (ADAMS Accession No. M1101940524) and used slide 35 to address the NRC question. In summary, the licensee used a 5-phase repair approach, and as of July 15th, they are in phases 4 and 5. The licensee stated that they would provide to the special inspection team a draft 10 CFR 50.59 evaluation by the end of the month.

Members of the public participated during the conference call. A member of the public asked if there is a tentative schedule for completion of repairing the containment and when the unit will be back online. The licensee stated that the unit will return to service by the end of the third quarter. Public Meeting Feedback forms were not received.
