Dear Ms. Flentje:
This e-mail is in reference to the NextEra Energy Point Beach, LLC (the licensee) submittal of a license amendment request (LAR)-264 dated January 27, 2010 (ADAMS Accession No. ML100280230), to revise Technical Specification 3.8.3, Diesel Fuel Oil and Starting Air. The licensee proposes to revise the diesel fuel oil storage volume requirements for the emergency diesel generators.
The U.S. Nuclear Regulatory Commission (NRC) staff in the Electrical Engineering Branch (EEEB) of the Office of Nuclear Reactor Regulation has reviewed the information provided in the LAR and determined that additional information is required to continue its review. In an effort to complete the review, the staff has developed draft requests for additional information (RAIs).
A conference call was held on July 23, 2010, between the licensee and NRC staff to discuss the draft RAIs. During the phone call, you recommended that the proposed draft RAIs should be divided since one of the RAIs appeared directly applicable to LAR-264 and the other to LAR-261 associated with extended power uprate (EPU).
The NRC staff have agreed to split the RAIs, as requested, and the draft RAIs associated with LAR-264 are attached. The staff wants to emphasize that resolution of the licensing bases (7 days versus 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />) concern is a priority since the EPU-related diesel fuel oil questions will be directly impacted by the outcome once the licensing basis is clarified and may potentially delay issuance of the EPU-related safety evaluation.
If required, the NRC staff can still discuss the draft RAIs with your staff in a conference call or meeting prior to formal issuance. Among other things, the discussion will include how the NRC would formally issue these questions and how the licensee will respond to them, including a proposed date for your formal response.
