ENTERGY GULF STATES LOUISIANA, LLC'S STATUS OF DECOMMISSIONING FUNDING ASSURANCE FOR RIVER BEND STATION, UNIT 1 (70% REGULATED) (TAC NO. ME0562)
Dear Sir or Madam:
By letter dated March 30, 2009, the U.S. Nuclear Regulatory Commission (NRC) received Entergy Gulf States Louisiana, LLC's (EGSL's) biennial decommissioning funding report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML090920218) for the River Bend Station, Unit 1 (RBS). By letter dated June 18, 2009 (ADAMS Accession No. ML091540293), the NRC staff informed Entergy Operations, Inc.
(Entergy, the licensee), that it needed to submit a plan to make adjustments to be on track to meet the required minimum amount of financial assurance. By letter dated August 13, 2009 (ADAMS Accession No. ML092260590), the licensee provided its plan to make up its shortfall in decommissioning funding. By letter dated October 14,2009 (ADAMS Accession No. ML092680611), the !\\IRC staff, among other items, requested additional information to determine whether the power purchase agreement with Entergy Texas, Inc. (ETI), met the requirements of Title 10 of the Code of Federal Regulations (10 CFR) paragraph 50. 75(e)(1 )(v) for use as decommissioning financial assurance. The licensee responded by letter dated November 12,2009 (ADAMS Accession No. ML093200212), which provided a copy of the power purchase agreement for the staff's review and stated the licensee's reasons for concluding that the power purchase agreement complied with the requirements of 10 CFR 50.75(v). By e-mail dated March 11,2010(ADAMSAccessionNo.ML100700358), the NRC staff requested additional information on details of the power purchase agreement. The licensee responded by letter dated May 10, 2010 (ADAMS Accession No. ML101520363).
By letter dated September 23,2010 (ADAMS Accession No. ML102660077), the NRC informed Entergy that, as part of this review, three apparent violations were identified and are being considered for escalated enforcement action in accordance with the NRC Enforcement Policy, which can be found on the NRC's Web site at http://www.nrc.gov/about nrc/regulatorv/enforcement/enforce-pol.html. A summary of the NRC's review and the basis for concluding that these issues represent apparent violations of NRC requirements were provided in the Enclosure to the letter dated September 23, 2010. As such, we consider our review of the Decommissioning Funding Report complete with the issuance of that letter. That letter also provided you an opportunity to U(1) respond to the apparent violations addressed in this letter within 30 days of the date of this letter, or (2) request a Pre-decisional Enforcement Conference (PEC)." Entergy's response will be reviewed as a new task action.
