RESPONSE TO YOUR LETTER DATED JUNE 16, 2010, TO NUCLEAR REGULATORY COMMISSION CHAIRMAN GREGORY JACZKO [LTR-10-0289]

Dear Mr. Gurdziel:

This letter is in response to your letter to Chairman Gregory B. Jaczko dated June 16, 2010, in which you expressed concern regarding the perceived lack of information available to the public regarding containment repair activities at the Crystal River Unit 3 facility. My understanding is that you subsequently had the opportunity to speak with two NRC staff members who described how information related to this issue can be accessed by the general public, and also provided some of that information to you.

On June 21, 2010, you spoke with Crystal River Senior Resident Inspector, Mr. Thomas Morrissey, over the phone. Mr. Morrissey called you in response to voicemail messages left at the NRC Resident Inspectors office in which you requested information on the containment repair activities at the Crystal River 3 facility. During that conversation, Mr. Morrissey explained various aspects of the containment repairs (such as, modeling of containment, structural integrity, and determination of tendon de-tensioning sequence) and that an NRC Special Inspection was ongoing. In addition, Mr. Morrissey contacted you on the morning of June 30, 2010, to inform you of a public meeting that was taking place the same day regarding Crystal River repair activities and provided you with the meeting teleconference information. I understand that you were able to participate in this public meeting via teleconference.

Mr. Morrissey also informed you of the NRCs Public Meeting Webpage and invited you to contact him if you had any further questions.

You have also been in contact with Mr. Mark Franke (contact for the Special Inspection) to address any additional questions you may have. For your information, Progress Energy and NRC gave a presentation on the Crystal River Unit 3 containment status at the NRC Regulatory Information Conference on March 9, 2010. Discussions regarding NRC inspections of the Crystal River containment repairs are contained in Crystal River Unit 3 Integrated Inspection Reports 05000302/2009005 and 05000302/2010002 (ADAMS Document Accession Numbers ML100250014 and ML101170619 respectively). Additionally, upon completion of the ongoing Special Inspection at Crystal River 3, the results will be documented in NRC Inspection Report 05000302/2009007.

T. Gurdziel 2 Crystal River Unit 3 containment repair activities were also mentioned and/or discussed in the following two public meetings:

  • Meeting with Progress Energy on Crystal River Unit 3 Containment Building Concrete Delamination - November 20, 2009 (ADAMS Document Accession Numbers for Meeting Summary and Handouts - ML093360229 and ML093240292)
  • Category 3 Open House Annual Performance Assessment Meeting - Crystal River Nuclear Plant - May 3, 2010 (ADAMS Document Accession Numbers for Meeting Summary and Handouts - ML101320029 and ML101320046)

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, the documents mentioned above and a copy of this letter either are available or will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). I trust that the above information addresses your concern. In order to meet our objective of openness and keeping the public informed, the NRC will continue the practice of communicating clearly and frequently on operating plant activities such as the Crystal River containment issues.
