Point Beach_RVHDrop_Supplemental Info Request_EMCB.docx Fritzie By letter dated June 1, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML101520200), NextEra Energy Point Beach, LLC (NextEra, the licensee) submitted a license amendment request to revise the current license basis regarding a postulated reactor vessel head (RVH) drop event to conform to the NRC-endorsed guidance of Nuclear Energy Institute (NEI) 08-05, Industry Initiative on Control of Heavy Loads, Revision 0 (ADAMS Accession No. ML082410532).

The purpose of this e-mail is to provide the draft results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or licensing basis of the plant.

As you and I discussed during a June 28, 2010, phone call, the NRC staff in the Mechanical &

Civil Engineering Branch (EMCB) in the Office of Nuclear Reactor Regulation has reviewed your application and concluded that the attached information is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.

In order to make the application complete, the NRC staff requests that NextEra supplement the application with a response that addresses the items identified in the attachment to this e-mail.

This will enable the NRC staff to begin its detailed technical review. If you desire to discuss the issues in the attachment, please contact me to set up a conference call. This call must be held within 5 working days of this e-mail, or by Wednesday, July 7, 2010. During that phone call, we can establish a date for the response. If you conclude that no conference call is necessary, then please notify me prior to July 7, 2010, so that a response due date can be set. If the information responsive to the NRC staffs request is not received by the established response date, the application will not be accepted for review pursuant to 10 CFR 20101, and the NRC will cease its review activities associated with this application.

After the phone call to discuss the draft requested information, I will make any necessary changes and send you an official letter documenting this portion of the acceptance review.
