OFFSITE PLANNING DEFICIENCIES IDENTIFIED DURING THE MAY 18, 2010 SALEM AND HOPE CREEK GENERATING STATIONS EMERGENCY PREPAREDNESS EXERCISE
Dear Mr. Joyce:
Enclosed is a copy of a letter from the Federal Emergency Management Agency (FEMA),
Region II Office, to the Commanding Officer, New Jersey Emergency Management Section dated May 26,2010. This letter discusses two planning deficiencies identified during evaluation of the May 18, 2010 emergency preparedness exercise at the Salem and Hope Creek Generating Stations. FEMA defines a deficiency as "an observed or identified inadequacy of organizational performance in an exercise that could cause a finding that offsite emergency preparedness is not adequate to provide reasonable assurance that appropriate measures can be taken in the event of a radiological emergency to protect the health and safety of the public living in the vicinity of a nuclear power plant." Specifically, the deficiencies involved the timeliness in developing and issuing a protective action decision to the public and inadequate and inaccurate information provided to the public via special news broadcast and several press releases.
The purpose of this letter is to communicate FEMA's official notification of the deficiencies that were sent to the New Jersey State Police Emergency Management Section. This letter is in accordance with the NRC-FEMA Memorandum of Understanding. No response to the NRC is required.
The NRC encourages PSEG Nuclear to work with the appropriate offsite governmental agencies to ensure a timely resolution of these issues. The NRC will continue to monitor the status of these issues. It is our understanding that a remedial exercise for the two deficiencies is required to be demonstrated within 120 days of the exercise date, May 18, 2010. In accordance with the NRC-FEMA Memorandum of Understanding, the NRC and the FEMA Region" Office will assess the progress made toward resolution of these issues, and will decide at that time if additional measures are necessary.
If these issues are not adequately resolved by September 18,2010, FEMA may withdraw the finding of reasonable assurance according to the requirements of 44 CFR 350.13(a). At that time, the NRC would take appropriate action according to the requirements of 10 CFR 50.54(s)(2) and 50.54{s)(3).

Salem Hope Creek Nuclear Generating Station 2010 Full Scale Exercise
[dentification of Issues Requiring Timely Corrective Actions
Dear Major McNulty,
The full-scale plume and ingestion pathway federally evaluated radiological emergency preparedness and response exercise held for the Salem Hope Creek Nuc lear Generating Station on May 18-20, 20 I O. We identified two issues that will require timely corrective actions and re demonstration. These issues have been discussed wilh your REP unit staff at the Participant's Briefing on May 21, 2010 and a meeting to discuss remediation is scheduled for June 3. 2010.
The first issue concerns the timeliness in developing and issuing a protective action decision to the public. This was caused by delays in crafting the message, not in actually making an appropriate decision. The process for preparing and approving messages needs to be streamlined in the procedures and re-demonstrated at a remedial drill that includes the State EOC, the Emergency News Center, and Salem and Cumberland Counties.
The second issue is that the New Jersey response organization provided inadequate and inaccurate information to the public in a Special News Broadcast and several Press Releases that was not corrected in a timely manner.
Due to the potential negative impact on public health and safety, we have classified these issues as Deficiencies, the most serious category. FEMA defines a Deficiency as ".., an observed or identified inadequacy of organizational perfonnance in an exercise that could cause a finding that offsite emergency preparedness is not adequate to provide reasonable assurance that appropriate protective measures can be taken in the event of a radiological emergency to protect the health and safety of the public living in the vicinity ofa nuclear power plant." 44 CFR 353, App.A.
