CONFIRMATORY ORDER (EFFECTIVE IMMEDIATELY) TO LICENSEE AND AN ORDER (EFFECTIVE IMMEDIATELY) TO AN INDIVIDUAL PROHIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES This is to inform the Commission of enforcement actions that will be issued on or about June 2, 2010, to Duke Energy Carolinas, LLC (Duke Energy) and one individual. These enforcement actions are based on two violations of NRC requirements at McGuire Nuclear Station, including a contract employee who deliberately introduced and used marijuana inside the protected area.
The actions consist of:
- 1. A Confirmatory Order to Duke Energy, confirming commitments agreed to during an Alternative Dispute Resolution (ADR) mediation session on March 29, 2010. Duke Energy has agreed to take the following actions: (1) develop a summary of lessons learned from the facts and circumstances surrounding the apparent violations and communicate this summary to its fleet wide employees; (2) perform a self-assessment of the adequacy of the programs and processes in place to detect and deter the introduction of illegal drugs and alcohol into the Protected Area of Duke Energys nuclear stations and implement appropriate enhancements in accordance with Duke Energys corrective action program; and (3) prior to December 31, 2010, perform an effectiveness review of the corrective actions identified in (1) and (2) above. This is in addition to several other corrective actions already completed by Duke Energy. In consideration of these commitments, and the corrective actions already completed by Duke Energy, the NRC agreed that the non-compliances will be characterized as a violation of 10 CFR Part 26, with a significance of Severity Level IV.
- 2. An Order prohibiting involvement in NRC-licensed activities for a period of five years to Ms.
Mary Files, a former contract welder at Duke Energy. This enforcement action is based on Ms.
Files deliberate failure to adhere to Duke Energy fitness-for-duty requirements. Specifically, on October 20, 2008, Ms. Files introduced and used marijuana inside the Protected Area at McGuire Nuclear Station.
The licensee and individual will be informed on or about the following dates:
