I noticed that your e-mails have a new section at the bottom regarding retransmission, dissemination etc.. We note comments from the State official, along with the NRC response, in the Safety Evaluation issued for the amendment. Usually we will place the e-mail string in our electronic document system (i.e. ADAMS) as a public document and reference the ADAMS Accession number in the Safety Evaluation (which is also a public document). - Brad, Yes, analytical margin is being recalculated to compensate for the degradation of the neutron adsorbing panels installed in the spent fuel pools. The licensee maintains that significant, conservative margins to the regulatory criterion have been preserved. The NRC staff is reviewing the licensees analysis.
You are also correct that some long-term resolution (such as equipment modification) will be required to address the degradation of the neutron adsorbing panels. In supplements that the licensee submitted under this license amendment request, they stated that a long term mitigation strategy is being developed to address the degrading panels.

- John, On this one they're talking about accepting a slightly less margin to criticality in the pools. Am I correct?
As long as long as both the new margin and methodology for calculating it is found acceptable by the NRC I have no further concern.
However considering further degradation over time, at some point won't they (the licensee) have to consider replacing the old panels?

Solicitation of Pennsylvania State Comments for Exelon TS Amendment Request Brad:
The NRC is reviewing a Technical Specifications license amendment request dated June 25, 2008, (ADAMS Accession No. ML081820302), for the Peach Bottom Atomic Power Station, Units 2 and 3. The amendment request seeks to revise Technical Specification (TS) 4.3.1.1.a concerning the spent fuel pool k value due to degradation of the boraflex neutron absorbing panels installed in the spent fuel pools. The NRC issued the attached Notice of Consideration in the Federal Register on April 26,2010 (75 FR 21680) which includes the No Significant Hazards Consideration analysis.
In accordance with 10 CFR 50.91(b), State Consultation, the NRC would like to know if the State of Pennsylvania has any comments regarding this license amendment request for Peach Bottom Atomic Power Station. We would appreciate a response by Tuesday, May 25, 2010.
