If four years without success (a FEMA-accepted emergency backup powered siren system) is not sufficient information, I would not know what is.

10 CFR 2.206 Petition dated 2 January 2010 re: Entergy/Indian Point Siren System Mr. Gurdziel, The Petition Review Board (PRB) met on January 25, 2010, to review your subject 2.206 petition request. The purpose of this message is to inform you of the results of the PRB meeting, and to explain the next steps of the PRB's review with respect to the 10 CFR 2.206 process.

The PRB recommended that your petition does not meet the criteria for review under 10 CFR 2.206 on the basis that the petition did not provide facts sufficient to constitute a basis for the requested action and to warrant further inquiry.

In accordance with the 2.206 process, the PRB is offering you an opportunity to comment on its decision, either by teleconference or in a meeting. This teleconference or meeting, if held, is an opportunity for you to provide any relevant additional explanation and support for your petition request in light of the PRB's recommendation.

Please let me know if you wish to comment on the PRB's recommendations at your earliest convenience, but no later than February 1, 2010. I can coordinate with you to establish a date/time to have this discussion with the PRB. In any event, an acknowledgement letter will be sent to you which will include the PRB's basis for its recommendation, respond, as appropriate, to the issues in your 2.206 request, and explain any further action, if any, the staff intends to take in response to your request.

10 CFR 2.206 Petition dated 2 January 2010 re: Entergy/Indian Point Siren System Mr. Gurdziel, Your petition dated January 2, 2010, was assigned to the Office of Nuclear Reactor Regulation (NRR) for review. My name is Rich Guzman, a project manager in NRR, and I've been assigned as a petition manager for your subject letter.

The 10 CFR 2.206 process is a public process, in which your petition and the NRC documentation related to your petition will be made public, including your identity. If you do not wish your petition to be made public, please advise us of that immediately and we can suggest other NRC processes to you, such as our allegation process. A copy of Management Directive 8.11 describing the 2.206 process in detail is attached for your information.

The NRC will convene a Petition Review Board (PRB) to discuss your 2.206 petition request.

During this meeting, the PRB will discuss the request to reach a reasoned decision whether the petition meets the criteria for under 10 CFR 2.206 process. After that meeting, you will be informed on the PRB's initial recommendation.

In accordance with the 10 CFR 2.206 process, the PRB is offering you an opportunity to address the PRB in person or by teleconference, before the PRB reviews the petition and makes an initial recommendation. This meeting or teleconference, if held, is an opportunity for you to provide any relevant additional explanation and support for your request in advance of the PRB's initial evaluation. Please let me know if you wish to address the PRB as soon as possible, but no later than January 22, 2010. Otherwise, as indicated above, you will be informed following the PRB's evaluation as to whether or not the petition has met the 2.206 criteria for review.
